Lawful Evictions for Non-Payment of Rent in Ontario
When a tenant isn’t paying rent it is important to follow the law carefully to avoid delaying eviction.
STEPS
The rent becomes overdue - the tenant does not make the required rent payment. At this point it is useful to send them a friendly reminder requesting payment
Serve your N4 Notice - The N4 form is the legal notice for non-payment of rent. Include the amount owed, the date it is due, and a warning that failure to pay may result in eviction. Make sure the notice is served correctly according to Ontario law.
Waiting Period - Tenants have 14 days (or 7 days for weekly tenancies) to pay the arrears or make arrangements. If payment is made in full, the eviction process stops.
File an L1 Application with the LTB - If the tenant does not pay, submit the L1 application for eviction. Include proof of service of the N4 notice and records of arrears.
TIPS
Keep clear records of all payments and communications with tenants
Address late payments early and communicate professionally
Always follow the LTB process to avoid legal complications.
