Lawful Evictions for Non-Payment of Rent in Ontario

When a tenant isn’t paying rent it is important to follow the law carefully to avoid delaying eviction.

STEPS

  1. The rent becomes overdue - the tenant does not make the required rent payment. At this point it is useful to send them a friendly reminder requesting payment

  2. Serve your N4 Notice - The N4 form is the legal notice for non-payment of rent. Include the amount owed, the date it is due, and a warning that failure to pay may result in eviction. Make sure the notice is served correctly according to Ontario law.

  3. Waiting Period - Tenants have 14 days (or 7 days for weekly tenancies) to pay the arrears or make arrangements. If payment is made in full, the eviction process stops.

  4. File an L1 Application with the LTB - If the tenant does not pay, submit the L1 application for eviction. Include proof of service of the N4 notice and records of arrears.
